Pennsylvania Attorney General Pappert Gives Opening Statement at Resumption Of Barnes Foundation Hearing: "NORRISTOWN, Pa., Sept. 21 /PRNewswire/ -- The following is the text of the
opening statement made by Attorney General Jerry Pappert in Montgomery County
Orphans' Court on September 21, 2004, at the resumption of the hearing
concerning the Barnes Foundation.

As the Court is aware, one of my most important responsibilities as
Attorney General is to act as parens patriae in all proceedings in the
Orphans' Courts involving charities. Consequently, my office has been
involved with the Barnes Foundation for many years, with its many appearances
in this Court in general, and with the current proceeding in particular.
My Office was consulted before the Petition was filed, and my predecessor
and I, as well as many members of my staff, met several times with the
Foundation trustees and representatives, as well as with representatives of
Lincoln University and the funding foundations. Those meetings, as well as
our familiarity with the Barnes Foundation and its issues, led us to insist
upon changes to the Petition so as to honor the wishes of Dr. Barnes by
preserving all terms of his Indenture which were compatible with the"
